TERMS OF SERVICE

GENERAL:
If you have a problem with any of these terms, they may be changed if discussed with me prior to paying for your commissioned piece.
By commissioning me, you are agreeing to my Terms of Service.
I reserve the right to reject requests that are beyond my abilities or interests, with or without explanation. Accepted requests do not indicate endorsement of any clients and associated parties.
I may stream, record, or post the commissioned work. Should the client require privacy, please make sure to select the NDA option in the request form.PAYMENTS:
• Commissions under $100 USD must be paid upfront.DEADLINES:
If anything comes up that will slow the progress of the initially estimated delivery time I will let you know asap!
• I will notify you when I have started on your commission.
• Once a deadline has been set, it may not be changed unless agreed on by both parties.REVISIONS:
The amount of free reviews depends on the type of commission.
• Big changes like pose, expression and background will only be done during the sketching/pre-lineart phase.
• A fee will be added if you want something changed once the drawing has been finalized - unless a misunderstanding from my side has been made.
• During the reviews, you will see work-in-progress and these images will usually include a watermark and be smaller than the finished piece.
• If the commission style is a Surprise me / Skeb commission, no revisions will be made.USE
Clients may:
• Use the commissioned piece for personal use.
• Print the artwork and claim the character(s) as their own, but not the artwork itself.
• Use the artwork to promote themselves. You are not forced to give me credit when you post it but it is very appreciated!
• Use the artwork on their monetized videos and streams as long as the artwork itself is not the main subject for the earnings.
Clients may NOT use the artwork for generative AI or NFTs in any capacity- this also includes usage of the artwork to promote generative AI or NFTs.INTELLECTUAL PROPERTY RIGHTS:
I retain the rights to use the illustration in portfolios and showcases (including social media posts and process recordings) unless otherwise indicated by the client. Other usage rights of the final image are solely reserved by the client and not permitted to other parties, unless the client specifies otherwise and confirms with me (SmoreOrLess).
Client and existing IP owners retain intellectual property rights for any designs and elements not created by myself.
Any edits of the final work by the client or by other artists must first be approved by me (SmoreOrLess). Client may NOT use the commissioned work for AI training or NFT (non-fungible tokens) under ANY circumstances.
Commissions are NOT intended to be sent to another artist for "completion" or further rendering. They are a stand-alone product.
Both artist and client may upload the commissioned work on any websites and SNS platforms.REFUNDS
I will never send art without payment first, but if I am unable to create art for your commission for any reason, refunds will be sent accordingly.
No refunds for finished pieces.
Partial Refunds may be administered in the case of an agreed upon deadline being delayed or a commission being unfinished. In this case, it will be discussed specifically with the client beforehand.
I will refund 100% of any commission request that does not adhere to my Request Guidelines or Terms of Service, but will not be creating art for the client in this case.
Should the client issue an unwarranted chargeback at any point (during or after), or fail to deliver the full request price, the client relinquishes any and all usage rights to the final product.COMMUNICATION
Client must stay in touch during the duration of the commission. If you fail to communicate with me within a week to questions and revision updates, work on the commission will continue regardless to ensure the deadline is met.
My response time might vary from anywhere from 1 to 3 business days unless specified otherwise.
Skeb-like/"surprise me" commissions will be accepted and delivered without direct communication, except in the case that I have made a mistake (please DM me if so).

Please stay consistent in your communications to ensure no messages are missed by me!REQUEST GUIDELINES
A minimum of 1 clear visual reference MUST be provided for all illustration requests. Moodboards are not acceptable if not accompanied by a proper reference. It is recommended to include a complete design reference for accuracy (such as a reference sheet, full-body artwork, detailed concept sketch, etc.). Otherwise, I may take creative liberties.
If the client has specific ideas in mind (such as composition, posing, expression, etc.), please include them in the request so that I may do my best to honor these preferences!
If the character has multiple outfits, please specify which outfit is desired for the request.
NOT PERMITTED: Explicit NSFW, discriminatory and hateful imagery
PERMITTED: Original characters, existing characters, light to medium gore, ships
TENTATIVE (please ask in request): Real people*, Mecha, furry/anthro art, action scenes
*Real people are complicated and depend on your specific request. I'm open to drawing online personas or promotional materials, but will not draw public figures.
